This Privacy Policy describes the information handling practices that apply when you access our website at arkmobileapp.com (the “Site”). Please read this Privacy Policy carefully. We may modify this Privacy Policy from time to time. Changes will be indicated by changing the date at the top of this page.

1. DEFINITIONS

For the purposes of this Privacy Policy:

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
  • Company (referred to as “the Company”, “Wander”, “We”, “Us” or “Our” in this Agreement) refers to Wander Corporation.
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • Platform means the arkmobileapp.com website (“Site”).
  • Application means the ARK mobile application advertised on the Site.
  • Service(s) refers to the Platform and the services provided through the Platform, including pre-release signup for an account to use the Application.
  • Service Provider means any natural or legal person who processes data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Services, to provide the Services on behalf of the Company, to perform services related to the Services or to assist the Company in analyzing how the Services are used.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Device means any device that can access the Service such as a cell phone, digital tablet, or computer.
  • Usage Data refers to data collected automatically, either generated during use of the Service or from the Service infrastructure itself.

2. ACCEPTANCE OF THIS PRIVACY POLICY

By accessing and using the Website, you signify acceptance of the terms of this Privacy Policy. This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your information when You use our Services, and informs You about Your privacy rights and how the law protects You. We use Your Personal data to provide and improve the Services. By using our Services, You agree to the collection and use of information according to this Privacy Policy. If You do not agree with or are not comfortable with any aspect of this Privacy Policy, You should immediately discontinue your use of our Services.

3. COLLECTING AND USING YOUR PERSONAL DATA

The Personal Information We Collect

You do not have to provide any Personal Information to access the Site. However, if you choose to create an account for use with the ARK application, we ask you to provide your full name, email address, and phone number. If you choose not to share this information with us, we will not be able to reserve your username in advance of the ARK release.

4. USAGE DATA

Usage Data is collected automatically when using the Platform.

When You access the Service by or through a device, We may collect certain information automatically, including, but not limited to, the type of device You use, Your device’s unique ID, the IP address of Your device, Your operating system, the type of Internet browser You use, unique device identifiers, the date and time of use, the functions you access, data on your patterns in copying and pasting and entering information, and other diagnostic data.

5. USE OF YOUR PERSONAL DATA

The Company may use Personal Data for the following purposes:

  • To provide and maintain our Service: including monitoring the usage of Our Platform and Service.
  • To manage Your Account: to enable and manage Your registration as a user of the Service. The Personal Data You provide allows us to reserve a username for your use when the ARK Application is released, and later match your information with a legal ID as part of our account verification process.
  • For the performance of a contract and/or to enforce our terms: the development, compliance and undertaking of the contract Services You have purchased or of any other contract with Us through the Service.
  • To ensure quality control: quality control and staff training to ensure you are provided with accurate information.
  • To contact You: by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as push notifications, regarding updates or informative communications related to the functionalities, products, or contracted services, including security updates, when necessary or reasonable for their implementation.
  • To provide You: with news, special offers and general information unless You have opted not to receive such information.
  • To manage Your requests: To attend to and manage Your requests to Us. 

We may share your personal information in the following situations:

  • With Service Providers: We may share Your personal information with our affiliated Service Providers to enable delivery of Services for you, to monitor and analyze the use of our Service, or to contact You if needed.
  • For Business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of our business to another company.
  • With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates may include parents, subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.

6. RETENTION OF YOUR PERSONAL DATA

The Company will retain Your Personal Data securely throughout the life of Your Account. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. The Company will retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Platform or Service, or if We are legally obligated to retain this data for longer time periods.

7. TRANSFER OF YOUR PERSONAL DATA

Your information, including Personal Data, is processed at the Company’s operating offices and in any other place where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those in Your jurisdiction.

Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.

The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.

8. DISCLOSURE OF YOUR PERSONAL DATA

Notwithstanding any other section of this Agreement, we will disclose your data to another party if we are required by law and are compelled to do so by subpoena, court order, or a similar legal procedure, as described below.

  • Business Transactions. If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.
  • Law Enforcement. Under certain circumstances, the Company may disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency). The Company may also disclose Your Personal Data in the good faith belief that such action is necessary to:
    • Comply with a legal obligation
    • Protect and defend the rights or property of the Company
    • Prevent or investigate possible wrongdoing in connection with the Platform or Service
    • Protect the personal safety of Users of the Service or the public
    • Protect against legal liability

9. SECURITY OF YOUR PERSONAL DATA

The security of Your Personal Data is important to Us but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, we cannot guarantee its absolute security.

10. THIRD-PARTY SERVICE PROVIDERS

Our Platform and our Service uses third party Service Providers for some functions. These Service Providers process information for Us and deliver services that we use to operate the Platform. To enable our use of their services, we provide your information to our Service Providers as needed.

If you do not want us to share your information with our designated Service Providers, we will not be able to provide you with functional access to the Platform and Service. In that event, You should close your account and discontinue your use of the Platform.

11. NOTICE TO EEA CITIZENS REGARDING THE GENERAL DATA
PROTECTION REGULATION (GDPR)

The European Union’s General Data Protection Regulation (GDPR) may apply to accounts owned by citizens of the European Economic Area (EEA). The following information applies if you are an EU citizen.

As explained above, we collect Personal Information in various ways depending upon your use of our Platform. We process Personal Information on the following legal bases:

(1) with your consent; (2) as necessary to perform our agreements; and (3) as necessary for our legitimate interests in providing services where those interests do not override your fundamental rights and freedom related to data privacy. The United States does not have protections in place for personal data as extensive as those within the EEA and may not provide adequate protection for personal data within the meaning of the GDPR. You may refuse to give or revoke your consent to this storage of your personal data at any time by emailing us with the subject line “Revoke EEA data consent.” If you are a citizen of a jurisdiction in the EEA and you decline to consent or revoke your consent, you will no longer be able to use our Services. We take Our responsibility to protect Your information very seriously. We use physical, technical, and procedural safeguards that comply with applicable legal standards to secure Your information from unauthorized access and use, alteration, and destruction. We process personal data based on consent according to Art. 6(1)(a) GDPR, which you are free to give or refuse. By using our Platform, you consent to our Privacy Policy. If you change your decision it will not affect the lawfulness of processing based on consent before its withdrawal.

Your Rights

You have the right to request access to, and rectification or erasure of personal data, and have the right to object to processing as well as the right to data portability. You also have the following rights:

  • the right to be informed

  • the right to rectification
  • the right to erasure
  • the right to restrict processing
  • the right to data portability
  • the right to object

12. CCPA AND COPPA

The California Consumer Privacy Act (CCPA) does not currently apply to Our operations. We provided the same privacy protections that we provide to our other U.S. customers (as explained in this policy) to our customers located in California. If that status changes, we will inform you and amend this privacy policy accordingly.

We do not provide our Platform or Services for use by anyone under the age of 18. Therefore, the Children’s Online Privacy Protection Act of 1998 (COPPA) and the rules created under that act do not apply to our operations.

13. CHANGES TO THIS PRIVACY POLICY

We will occasionally update this Privacy Policy. When changes to this Privacy Policy are posted, the date at the top of this Privacy Policy will be revised and we will provide a notice through the Platform. We recommend checking this policy from time to time to inform yourself of any changes in this Privacy Policy.
